Baumann describes the origins and history of the non-delegation doctrine and the major questions doctrine, explaining how both are rooted in an ideological fantasy of a Congress that never existed, ultimately in service of judicial self-aggrandizement. He reflect on how that happened, why it's a problem, and how scholars should understand it.
