The Supreme Court is considering that question in United States v. Trump and will hear oral argument in the case on April 25.

Roth Professor of Law and Dean Emeritus of NYU School of Law; and Kate Shaw a Professor of Law at the University of Pennsylvania Carey Law School. Andrew Weissmann, a Just Security Editor and Faculty Co-Director of the Reiss Center on Law and Security at NYU School of Law, moderated the discussion.
