    In Notorious Confirmation of ACB, host Nii Amaa Ollennu shares his journey from triggered to informed. In this episode, Jack and Nii discuss dynamics of the appellate courts, the importance of balance, and the politicization of the nomination and confirmation process.

    Background:

    The US Constitution is the supreme law of the United States. It sets out the limits under which our government can operate. The Constitution does not set forth requirements for place of birth, age, or education or profession of Justices.

    Congress and the President are given the power to establish the number of Justices sitting on the Supreme Court, as well as the judges in the other 2 levels of federal court. The 1869 Judiciary Act solidified the number of Justices on that Court at 9 and established a 6 Justice quorum.

    On February 13, 2016, the late Justice Antonin Scalia passed away. On March 16, President Obama nominated Merrick Garland for the vacancy. The Senate Judiciary Committee refused to act on that nomination.

    On September 18, 2020, the late Ruth Bader Ginsberg passed away. On September 19 Lindsey Graham tweeted his support to fill her former seat.

    During the confirmation process, an article claimed Justice Barrett stated that “calling a Black employee the N-word does not make for a hostile work environment.”
